By accessing or using our website at emithelabel.com.au, you agree to these Terms & Conditions.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy available to you under the Australian Consumer Law (ACL) or any other applicable law that cannot be excluded.

2. Products & Orders

All products are subject to availability. We may limit quantities or discontinue products at any time.

When you place an order, you confirm that:

• You are legally capable of entering into a binding contract

• All information you provide is accurate and complete

We reserve the right to refuse or cancel any order, including where there is an error in pricing, product description, or availability. If payment has already been processed, you will be refunded in full.

3. Pricing & Payment

All prices are listed in Australian Dollars (AUD) and include GST where applicable.

Payment must be made in full at the time of purchase. Payments are processed securely through third-party payment providers. We do not store your payment details.

4. Shipping & Delivery

Shipping fees and estimated delivery times are displayed at checkout.

Delivery timeframes are estimates only and may be affected by factors outside our control. We are not liable for delays caused by third-party delivery providers.

You are responsible for ensuring delivery details are correct. If an order is returned due to an incorrect or incomplete address, additional shipping fees may apply.

Risk in the goods passes to you upon delivery to the address provided.

5. Returns, Faults & Consumer Guarantees

Our Returns Policy forms part of these Terms.

We comply fully with Australian Consumer Law. You are entitled to a replacement, repair or refund if goods are faulty, damaged, unsafe, or not as described.

For issues or faults, please contact us at hello@emithelabel.com.au with your order number and supporting images or videos. We will assess the issue and provide an appropriate remedy in line with ACL.

Change of mind returns are handled in accordance with our published Change of Mind Returns Policy.

6. Change of Mind Returns

Where a return is not required under Australian Consumer Law, we may offer store credit at our discretion, subject to eligibility requirements set out in our Returns Policy.

Sale items, gift cards, final sale items and intimate items with removed hygiene seals are not eligible for change of mind returns unless faulty.

7. Intellectual Property

All content on this website — including text, images, designs, logos and branding — is owned by or licensed to Emi the Label.

You may not reproduce, distribute or use any content without our prior written consent.

If you submit feedback, reviews or suggestions, you grant us a non-exclusive, royalty-free right to use that content for business or promotional purposes.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the website or purchase of our products.
